Why is Delta – 8 THC Legal?



Delta-8 THC has found a legal loophole in many jurisdictions due to the specifics of how laws are written regarding cannabis and its derivatives. The 2018 Farm Bill, which is federal legislation, legalized hemp and hemp-derived compounds, extracts, and derivatives by removing them from the definition of marijuana in the Controlled Substances Act. The bill defines hemp as any part of the Cannabis sativa plant containing less than 0.3% delta-9 THC, which is the primary psychoactive compound in cannabis.


Delta-8 THC is chemically different from delta-9 THC by only a few atomic bonds but has a similar psychoactive effect, though often reported to be less potent. Since the Farm Bill's language specifically mentions delta-9 THC, delta-8 THC derived from legally grown hemp technically falls outside of this definition and thus is not explicitly controlled under federal law. This oversight, whether intentional or not, has led to the rise of delta-8 THC products in markets across the United States.


However, the legality of delta-8 THC is not universally accepted across all states. Some states have moved to explicitly ban delta-8 THC, treating it the same as delta-9 THC, due to concerns about its psychoactive effects and the unregulated market. Other states allow its sale and use within certain restrictions, akin to CBD and other hemp-derived products.


It's important to note that the legal landscape regarding delta-8 THC is evolving. Regulatory agencies like the Drug Enforcement Administration (DEA) and the Food and Drug Administration (FDA) may issue clarifications or enforce regulations that could affect the legality of delta-8 THC products. Additionally, state laws can change rapidly, further complicating the matter.


Due to these complexities, individuals interested in purchasing or using delta-8 THC products should stay informed about the current laws in their state and be aware that the legal status of these products could change.
